Terms and Conditions of YMCA Fylde Coast Membership

Direct Debit Guarantee

1. About This Agreement

These Terms & Conditions form a legally binding agreement between you (“the Member”) and YMCA Fylde Coast (“the Centre”). By joining, you agree to comply with these terms, the Centre Rules, and any reasonable updates made in accordance with UK law.

2. Eligibility

• Membership is available to individuals aged 14 or over.
• Members aged 14-16 may join with written consent from a parent or legal guardian.
• Proof of age must be provided.
• If you are aged 14-17 you will be a Y:Teen member. Anyone aged 18 or over found purchasing this membership will have their membership cancelled and refunded (pro rata) for the amount paid. Members must be aged 14+.

3. Membership Types

Membership options vary by price, commitment length, and included services. Your selected membership details form part of this agreement.

• Y:Adult (Age 18+) Access all areas (operated by YMCA Fylde Coast), except the Active Wellness Suite at YMCA St Annes, during usual opening times. No time restrictions. Available as a one-off annual payment or a monthly rolling subscription.
• Y:Wellness (Age 18+) Access to the Active Wellness Suite at YMCA St Annes only. This membership includes restricted access to low-impact group exercise classes. A Y:Wellness referral membership is only available to those who qualify based on specific criteria and who are referred by a health professional.
• Y:Teen (Age 14-17) Restricted access based on the age of the member. Available as a one-off annual payment or a monthly rolling subscription.

4. Fees and Payments

• Membership fees are payable in advance by Direct Debit, credit/debit card, RCP (recurring card payment), or other approved methods.
• All prices include VAT where applicable.
• Fees may be reviewed periodically. Any increase will be communicated with at least 30 days’ notice, and you may cancel if you do not accept the change.
• No payment will be refunded if the member does not comply with the cancellation notice period.
• Missed payments may result in restricted access until the account is brought up to date, without arrears.

5. Cooling-Off Period

In line with UK consumer law, you may cancel your membership within 14 days of joining for a full refund, provided the membership has not been used. If facilities have been used, a reasonable charge may apply.

6. Cancellation Policy

• Monthly memberships may be cancelled with at least 15 days’ notice of the renewal date.
• Notice must be given in writing via email or YMCA Fylde Coast’s official cancellation process, online.
• Members wishing to cancel their subscription must request cancellation in person at either YMCA Lytham or YMCA St Annes. A member of staff will complete a cancellation form on behalf of the member.

• Members must not cancel their direct debit with the bank themselves or cancel their RCP (recurring card payment) on the mobile app themselves. It is YMCA Fylde Coast’s responsibility to cancel the membership and stop any recurring payment.
• Fixed-term memberships may only be cancelled early in exceptional circumstances (e.g. medical reasons or relocation), subject to evidence and management approval. Refunds may not be given in this circumstance.

7. Agreement to Recurring Billing

By purchasing our services, you authorise YMCA Fylde Coast to charge your selected payment method on a recurring monthly or annual basis in accordance with the membership plan you selected.

• Monthly memberships on autorenewal: your membership will be charged once every month, at the current monthly rate.
• Members on an annual charge can opt out of autorenewal.

8. Payment Authorisation

By enrolling in auto-renewal:

• You authorise us to store and securely process your payment details.
• You authorise recurring charges without additional approval prior to each charge.
• Charges will continue until you cancel in accordance with our cancellation policy in section 6.

9. Failed or Declined Payments

If a payment is declined:

• We may attempt to process the charge again.
• Your access to services may be suspended until payment is successfully received.

10. Refund Policy

• Monthly subscription fees are non-refundable once charged.
• Refunds, if applicable, are issued at our sole discretion unless otherwise required by consumer protection laws.

11. Freezing Memberships

• Only annual memberships can be frozen.
• Memberships may be frozen for medical reasons or other genuine circumstances, subject to approval.
• Medical freezes require supporting documentation from a healthcare professional.
• Members must provide proof of booking for extended holidays.
• Members can only freeze their membership for a maximum of 1 (one) time per year.
• Freeze periods are typically limited to 1–3 months.

12. Access and Use

• Memberships are strictly non-transferable.
• Members must check in using their physical or digital membership card on every visit.
• Sharing access, tailgating, or misuse of entry systems may result in termination without refund.
• Persons wishing to become members must complete a membership form and health PAR-Q and accept our liability waiver and health commitment statement.

13. Health and Safety

• Members must confirm they are medically fit to exercise or have sought appropriate medical advice.
• Exercise is undertaken at the member’s own risk.
• The Centre is not responsible for injury caused by misuse of equipment or failure to follow staff instructions or safety signage.

14. Personal Property

Personal belongings are brought onto the premises at the member’s own risk. Lockers are provided for convenience only. The Centre accepts no liability for loss, theft, or damage.

15. Conduct

Members must behave respectfully toward staff and other members. The following may result in immediate termination without refund:

• Abusive, threatening, or discriminatory behaviour
• Damage to property
• Harassment or intimidation
• Illegal activity

16. Classes and Personal Training

Classes and Personal Training

• Classes and PT sessions are subject to availability and may require advance booking.
• YMCA Fylde Coast reserves the right to change instructors, timetables, or cancel sessions where necessary.

17. Changes to Facilities or Services

The Centre may make reasonable changes to opening hours, equipment, classes, or services. Temporary closures for maintenance or upgrades do not entitle members to refunds.

A YMCA Fylde Coast membership entitles you access to YMCA Fylde Coast-operated leisure centres only.

Changes in contractual operations of leisure centres in partnership with local councils (Fylde Borough Council and Wyre Council) do not entitle members to a refund.

18. Limitation of Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law. Otherwise, the Centre’s liability is limited to the maximum extent permitted by law.

19. Data Protection

Personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018. Full details are available in YMCA Fylde Coast’s Privacy Policy.

20. Governing Law

These Terms & Conditions are governed by the laws of England and Wales (or Scotland / Northern Ireland, if applicable.
